Acceptance of these terms

These Terms of Use are an agreement between you and Buknal Enterprise LLC ("we," "us") covering the YardKit app ("the App"). By downloading or using the App, you accept these terms and Apple's Licensed Application End User License Agreement (the "Apple EULA"). If you don't agree, don't use the App.

Our Privacy Policy explains how information is handled and forms part of these terms. You must be at least 13 years old, and old enough to form a binding contract where you live, to use the App.

Your license to use YardKit

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the Apple EULA and the App Store Terms of Service. You may use it for your own properties and for lawns you personally maintain.

You may not:

• Copy, modify, translate, or create derivative works of the App;
• Reverse-engineer, decompile, or attempt to extract its source code;
• Sell, rent, sublicense, or redistribute the App or your access to it;
• Remove proprietary notices, or use our name, logo, or content without permission;
• Use automated means to access the App's features or the services behind them, or use them in a way that burdens or disrupts those services.

We retain all rights in the App, including its plans, content, design, and trademarks.

Subscriptions and billing

YardKit is free to download and offers optional auto-renewing subscriptions. Prices at the time of writing are $4.99 per month and $29.99 per year. Current pricing is always shown in the App before you purchase, and may differ by region.

• Payment is charged to your Apple Account at confirmation of purchase.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the end of that period.
• Manage or cancel a subscription in Settings → [your name] → Subscriptions. Deleting the App does not cancel a subscription.
• If a free trial is offered, any unused portion is forfeited when you buy a subscription.

All purchases are processed by Apple, and refunds are handled by Apple under the App Store Terms of Service, not by us. We may change prices or features; changes to an existing subscription's price take effect at the next renewal after Apple notifies you, and you may cancel before then.

Lawn care guidance is informational

YardKit builds care calendars, reminders, and product quantity estimates from your grass type, location, and weather data. This guidance is general information, not professional agronomic, horticultural, environmental, or legal advice. Lawns vary, and so do soil, drainage, shade, and local conditions.

The App's fertilizer blackout and restriction alerts are provided as a convenience. Regulations change and vary by state, county, municipality, and water district, and our information may be incomplete or out of date. You are responsible for confirming and complying with the rules that apply to your property, and for following the manufacturer's label on every product you apply. The label is the law. Keep children and pets away from treated areas as the label directs.

You are responsible for how you use any product, tool, or equipment, and for any damage to your lawn, plants, property, water supply, or health resulting from it.

Plant identification

Plant identification uses a third-party service and returns suggestions based on probability, not verified determinations. Results are frequently wrong, especially from unclear photos or for young plants.

Never rely on YardKit to decide whether a plant is safe to touch, eat, or give to a child or animal. Do not use it to identify mushrooms or to assess toxicity. Consult a qualified expert, your local extension service, or poison control for anything involving safety.

Lawn measurement

Camera measurement produces an estimate. Accuracy depends on your device, lighting, terrain, and how you walk the area. Verify measurements before buying materials or applying products by quantity, and treat any resulting application rate as an estimate you are responsible for checking.

Your content

The properties, notes, and photos you add to the App are yours. We don't claim ownership, and, as described in the Privacy Policy, they stay on your device and in your own iCloud account, except for photos you choose to submit for plant identification, which are sent to the identification service to produce a result.

You are responsible for your content and for keeping your own backups. We are not responsible for content lost through device failure, deletion, iCloud problems, or uninstalling the App.

Acceptable use

Use the App lawfully. Don't use it to infringe anyone's rights, to submit content you have no right to submit, to interfere with its security, or to attempt access to systems or data you aren't authorized to reach.

Third-party services

The App depends on services we don't control, including Apple WeatherKit, Plant.id, and Google Firebase. Their availability, accuracy, and terms are theirs, not ours. We may add, replace, or remove such services, and features that depend on them may change or stop working. Weather data in particular is a forecast, and forecasts are wrong sometimes.

Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We don't warrant that the App will be uninterrupted, error-free, or that its plans, identifications, measurements, weather data, or regulatory information will be accurate or produce any particular result for your lawn.

Some jurisdictions don't allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Buknal Enterprise LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising out of your use of the App. This includes damage or loss relating to:

• Damage to lawns, plants, gardens, soil, or property from products applied or timing followed;
• Fines or penalties from fertilizer, irrigation, or other local restrictions;
• Incorrect plant or weed identification;
• Inaccurate measurements or product quantity estimates;
• Inaccurate or delayed weather data, reminders, or notifications;
• Loss of journal entries, photos, or other data.

Our total liability for any claim relating to the App is limited to the greater of the amount you paid us for it in the 12 months before the claim, or $50 USD. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

Apple's role

This agreement is between you and us, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.

We, not Apple, are responsible for addressing any claim that the App or your use of it infringes intellectual property rights, and for product liability claims, claims that the App fails to conform to legal requirements, and claims under consumer protection or similar laws, to the extent the law allows. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Termination

You may stop using the App at any time by deleting it; remember to cancel any subscription separately through Apple. We may suspend or terminate your license if you breach these terms. Sections that by their nature should survive termination, including the disclaimers, limitation of liability, and governing law, survive it.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction. If you are a consumer elsewhere, this doesn't deprive you of the protections of the mandatory laws of your country of residence.

If any provision of these terms is found unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms as the App changes. The updated version takes effect when posted on this page, with a revised "Last updated" date. Continuing to use the App after a change means you accept the new terms.
