Acceptance of these terms

These Terms of Use are an agreement between you and Buknal Enterprise LLC ("we," "us") covering the TimeConvertR app and its widgets ("the App"). By downloading or using the App, you accept these terms and Apple's Licensed Application End User License Agreement (the "Apple EULA"). If you don't agree, don't use the App.

Our Privacy Policy explains how information is handled and forms part of these terms.

Your license to use TimeConvertR

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the Apple EULA and the App Store Terms of Service. You may use it in your own work, including work you do for an employer.

You may not:

• Copy, modify, translate, or create derivative works of the App;
• Reverse-engineer, decompile, or attempt to extract its source code;
• Sell, rent, sublicense, or redistribute the App;
• Remove proprietary notices, or use our name, logo, or app icon without permission.

We retain all rights in the App, including its design, content, and trademarks. The 12-hour and 24-hour time formats themselves are common conventions and are not claimed by us.

A conversion aid, not an official record

The App converts the time you enter, or the time on your device's clock, between the 12-hour and 24-hour formats. Its results are only as accurate as your input and your device's clock and time zone settings. The App:

• Does not convert between time zones. A time in a flight itinerary or schedule is usually local to the place it refers to, which may differ from the time zone your device is set to;
• Is not an official or certified time source, and is not a clock, alarm, or reminder;
• Is not a medical, aviation, or military record-keeping system, and doesn't replace the procedures or systems your organization requires.

Where a time affects health, safety, legal records, or travel, such as when you're giving or charting medication, logging flight or duty time, writing an official report, or catching a connection, confirm it against the original source and follow your employer's, facility's, carrier's, or agency's procedures. Those procedures take priority over the App.

You are responsible for how you use the times the App shows, including any missed appointment, flight, or dose, or any record entered on the strength of a conversion, whatever the App displayed.

Acceptable use

Use the App lawfully, and don't interfere with its operation or security.

Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We don't warrant that the App or its widgets will be uninterrupted or error-free, or that the time shown will always be current. Widgets are refreshed by iOS on its own schedule.

Some jurisdictions don't allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Buknal Enterprise LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenue, or goodwill, arising out of your use of the App. This includes damage or loss relating to:

• Missed or late flights, trains, appointments, meetings, or shifts;
• Medication given, charted, or scheduled at the wrong time;
• Errors in logs, reports, charts, or other records;
• Incorrect results caused by incorrect input, or by your device's clock or time zone settings.

Our total liability for any claim relating to the App is limited to the greater of any amount you paid for it in the 12 months before the claim, or $50 USD. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

Apple's role

This agreement is between you and us, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation.

We, not Apple, are responsible for addressing any claim that the App or your use of it infringes intellectual property rights, and for product liability claims, claims that the App fails to conform to legal requirements, and claims under consumer protection or similar laws, to the extent the law allows. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your license if you breach these terms. Sections that by their nature should survive termination, including the disclaimers, limitation of liability, and governing law, survive it.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction. If you are a consumer elsewhere, this doesn't deprive you of the protections of the mandatory laws of your country of residence.

If any provision of these terms is found unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms as the App changes. The updated version takes effect when posted on this page, with a revised "Last updated" date. Continuing to use the App after a change means you accept the new terms.
